Notice on Jointly Conducting “Efforts to Combat Fake Fertilizers”


To All Fertilizer Enterprises:

To strengthen self-discipline within the fertilizer industry, purify the fertilizer market, protect the legitimate rights and interests of farmers and law-abiding enterprises, and maintain a fair competitive market order, entrusted by the State Administration for Market Regulation, the China Nitrogen Fertilizer Industry Association, the China Phosphate and Compound Fertilizer Industry Association, and the Potash Salt and Potash Fertilizer Branch of the China Inorganic Salts Industry Association have decided to jointly launch a “Fertilizer Anti-Counterfeiting Campaign.” This initiative aims to assist market regulation and law enforcement authorities at all levels in cracking down on illegal practices in the fertilizer industry, including adulteration and counterfeiting, underreporting nutrient content, falsely labeling product specifications, passing off inferior products as superior, misrepresenting product concepts, trademark infringement, and false advertising. All fertilizer enterprises are urged to actively identify and investigate leads related to counterfeit and substandard fertilizers and promptly report such information to their respective industry associations. The relevant requirements and recommendations are hereby notified as follows:

1. Strengthen leadership and build a robust anti-counterfeiting team.

Each fertilizer enterprise shall assign a senior executive to oversee anti-counterfeiting efforts, establish an anti-counterfeiting office, designate specific personnel to be responsible for anti-counterfeiting-related tasks, and complete the “Registration Form for Senior Executives in Charge of Anti-Counterfeiting Work and Contact Persons at Fertilizer Enterprises” (see Appendix 1). This form must be submitted to the relevant industry associations by June 15.

II. Conduct thorough self-inspections to ensure product compliance.

All fertilizer enterprises should strengthen their study of laws and regulations related to fertilizers, conscientiously conduct self-inspections in accordance with these regulations, and ensure that their product quality, packaging, and promotional materials comply with the relevant regulatory requirements.

III. Strengthen the implementation of work tasks

Each enterprise shall develop an anti-counterfeiting work plan, clearly defining the tasks and division of responsibilities for anti-counterfeiting efforts, establishing incentive mechanisms, and organizing marketing personnel and agents to collect leads on counterfeit and substandard fertilizers. Additionally, enterprises should assign staff to follow up on these leads, investigate and dismantle counterfeit production sites. When collecting leads and conducting investigations, it is crucial to maintain confidentiality and ensure the personal safety of all personnel involved.

IV. Requirements for Providing Clues

1. The reporting materials for clues about counterfeit and substandard fertilizer products should include: the location where the problematic product was discovered (specifying the particular store or factory), photographs of the product’s packaging (one photo each from the front and back sides; it is recommended to retain the location and time of the photos), photographs or videos of the product, photographs or videos of the stores selling the product, an estimated quantity of the product, and the name and contact information of the person providing the clue. For details, please refer to Appendix 2, “Registration Form for Clues about Counterfeit and Substandard Fertilizer Products.”

2. Effective immediately, once any enterprise discovers clues indicating counterfeit or substandard fertilizer products, it must promptly take corrective action and promptly report the findings to the association.

3. Submission Method: Complete the “Registration Form for Clues on Fake and Substandard Fertilizer Products,” and attach relevant product images, videos, and supporting documentation. Send the completed form via email to the respective industry associations.
